Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.

H1, H4 (spouse) and H4 (kid) living happily.

File 485 and gets EAD/AP.

H1 doesn't use EAD.

H4 uses EAD and hence looses H4 status.

I-485 is denied.

Now, my understanding is that spouse has to go out of country and come back again on H4.

What about the kid?

When does the kid loose his/her H4 status? (When both mother and father use EAD)?

This is just my thought, I would believe when the father (or whoever was on H1) uses EAD, the subsequent H4's would get canceled and their status would be Pending AOS. If 485 is denied, and if H1 person has not used EAD, then both son and mother can re enter on H4.

Hi!
I was wondering what are the benefits of EAD to primary(H1B) applicant before 180 days, i understand that AC21 & it's benefits can be invoked after 180 days from receipt date.
But is there any benefit of having EAD if 180 days from 485 receipt date are not over ?

You can take a 2nd additional job if needed..
Not much benefit if your current job is well paying and going well... Even though I applied for EAD, I am not planning to use it.. But just in case.. You never know WWW in US...

And when you invoke AC21.. You must have EAD in hand...

NB: WWW = Work Women Weather...

I do not have personal experience with Fragomen; however I have heard that it is the large immigration law firm in the country.

The only problem (as far as I know) with them is that your PERM WILL be audited (according to DOL memo). This may lead to delays (and god only knows how long...)

Most people on this forum know this fact; I mentioned it as you appear to be the novice player...

Reading through this, I couldn't quite figure the immigration requirements of the PAPs - appears that non-citizen residents of the US (NRIs) can also adopt - or am I missing something?
