    Hi

    After changing the address on sunday, there were soft luds for 2 days on all pending 485.

    Is this same with all address change.Last time it took 3 weeks to get the letter.

    Any experiences?

    When I did it in Delhi at US embassy there was an officer at the embassy counter just before entering into the embassy when you are at the line outside with your papers, he checks your documents. For me he checked my papers and wrote on them " PIMS found". After that i went into the embassy to get into the another line to talk to officer inside.

    Though it was 3 years back I am not sure if its done the same way now also.

    Yes, you are missing something. Check his 485 filing date and his adjudication date.

    This is about nurses amendment and DREAM act being "Introduced" in senate and house respectively.

    There are 535 members in the US congress. 100 in Senate. 435 in the House. Any one of them can draft a bill, make a print-out and "drop" it in the House/Senate. And once "dropped"(Introduced) it can be up on thomas.loc.gov in 2-3 business days.

    However, a mere "INTRODUCTION" not worth a bucket of warm spit.

    If the leadership of House/Senate do not take up the bill on schedule, then all that the bill does is

    1. Make a position statement for the lawmaker. Better way to state your position than a press release.

    2. Appease the special interest who are pushing that office to "Do something".

    3. Keep it as a place-holder for future consideration. If ever there is an opportunity, they can push to make that intro-bill an amendment to a bigger bill. Examples : SKIL bill became amendment of CIR last year, DREAM act, AGJOBS bill etc.

    Please pay attention to capitol hill before carping about nurses and agricultural visas and before crying/complaining.

    And please please talk to some office in leadership. EVERYONE will tell you that "WE WONT ALLOW ANYTHING BEFORE CIR IS DISCUSSED, DEBATED AND VOTED UPON". Nothing means nothing. No SKIL, No Agjobs, No nurses, No Small-tiny-teeny-weeny bills, no sneaky amendments in spending bills. NOTHING.

    Hi,

    My Priority date is May 02 2007.

    I file 485 and 140 in August.

    My Grandfather is a US citizen. He filed immigration petition for my Dad in 1996 and I was part of it. Before priority date become current I was age out.

    Can I port my Earlier(Family Base) PD to new application(Employment Base) ?

    It is true that immigration is not at all reason for unemployment. When unemployment increases that will decrease immigration to some extent. We could see that in h1b numbers and also illegal immigration. But future immigration will depend on how fast jobs are created when recovery starts.

    if DREAM act passes. children staying here illegally will be able to sponsor GC for their parents staying here illegally, after 5 years. and we will still be DREAMing about our GCs.

    I want to do H1 transfer . But I do not have pay stub of Jan and Feb 2009 . Right now I got a project which will be starting from March 1 to 31 March . But before that I want To Transfer my H1 . Doses H1 Transfer need recent Pay Stubs ?

    Doesnt matter how many threads you create to ask the same question, but I am afraid the response you will get will ramain the same. "You do need pay stubs". Hope this helps.

    No matter how you feel about the alleged shortage, you have to acknowledge that the H1B gives the employer a remarkable amount of power over the employee's life. The employer bestows the right to live in the United States upon the employee, and often sponsers the employee's application for a green card. Changing employers is not impossible, but it is tricky and perilous.

    As an American, I can quit my job and become a contractor. An H1B can't. If my girlfriend decides to move across the country for a new job, I can quit my old job and go with her. An H1B can't. If I decide I'm tired of programming, I can quit and apply to law school. An H1B can't. And, most importantly, if I think I'm talented and should earn well above market rate, I can go into my boss's office and negotiate with the knowledge that I'm free to find a better deal elsewhere. Well, the most likely explanation is that the corporations who lobby for this visa *enjoy* this power over engineers. And this, in turn, leads to work conditions that drive America's best and brightest away, into careers in law, medicine, finance, and so forth, exacerbating the very shortage that the visa was designed to address.

    Unlike some of the posters here, I'm ok with the existence of skilled worker visas. But any increase should be off the table until basic human and economic freedoms are preserved for the worker. In America, you have the right to quit your job. Period. "

    Hi,
    I am a green card holder via the DV program of 2007 and my husband is on student visa. We had entered US individually prior to our marriage. Our marriage took place back in Nepal in 2008 and considering the long waiting period for the dates to become current, I didn't file I-130 for my husband immediately after our marrigage thinking that we would wait for my citizenship. But now seeing the advancement in the current dates for Family based visa, I would like to file the I-130 for my husband. Please advise what my best bet would be? Wait until I get my citizenship or file now? Also if I file now, how long might it take for him to get his EAD and GC?
    Can I file the I-130 form on my own for would need to get a lawyer for that. Currenlty we are in Seattle, Washington.
    Any suggestions will be highly appreciated.

    AFAIK they dont know unless USCIS issues an RFE for tax returns. What was her status before she filed her 485?
    Also why are you concerned whether they know or not?

    Before that she was on H-4, I am still on H-1B

    yes, that is correct, i meant can i got for H-1 stamping while 485 is pending
    and ead/ap is approved.
    Again in case the H-1 stamping is denied for any reason , can i come back on AP

    I am a little concerned of H1 stamping being a problem because my case is complicated ,for the years June 2005- June 2006 i dont have a H1 approval from USCIS for the 6th year, This was because the case was stuck in a security check .
    We applied a case again in April 2006 , which was approved on August 2006 ( after the security check has been completed ).

    Visa Interview: Que on Permission to enter New Delhi Embassy for 2 yr 3 months old Son

    I am working in USA. I am planning to travel to India next month and require to apply for USA Visa interview.

    I have 2 years and 3 months old younger Son who is born in USA and is a American Citizen holding American Passport.

    Could you please shar exp. if he will be allowed to be with us during our Visa Interview in New Delhi Embassy. if Yes. pls let me know if there is any requirement for his entry inside the New Delhi Embassy.

    I am currently working for Company A which sponsors my H1B. I wonder if I can work for another company on a part time basis. What's the requirement for concurrent H1B filing? And does concurrent H1B filing requires a new H1B application against the quota? Please provide guidance.

    why do u want to work part time on H1 with multiple employers?

    Why can't u go for full time with Company A??

    Hello All,
    I got my H1B in 2006 and started working in Nov 2006. My employer while filing my H1 petition- on my LCA mentioned that I would work in OH.

    From Jan this year, I started working in NJ but my employer did not file a LCA for NJ.

    Now I have to get my H1 stamped from Mumbai consulate and the lawyer tells me that this could be a problem.
    As of now, he filed LCA for NJ, but says that he doesn't have a answer to why it was not done in Jan and that my stamping at Mumbai.

    Has anyone faced such a issue.

    Please share your experiences and views.

    you can check with a lawyer to be sure ,

    but what i think is -->

    since u have a new born Kid in india which u wish to bring to the US, i think that would be only possible at this point if you sponsor a H4 for him. And for you to sponsor h4 for him means you will need to continue to be on H1 visa.

    Your decision to continue to use H1, will not affect your Ead/AP. But once again, until you apply 485 for your kid , it will need H4 status to remain in the US, hence forcing u to stay on H1.

    Hello Guys,

    I never received FP notice and got EAD/AP almost three weeks back. Is there a need to worry? or just wait..

    My application reached to texas..they transfered to Cal...cal issued the EAD/AP and senta transfer notice for 485 to nebraska..didn't hear anything from nebraska..
