I was in same situation, My Labor & I 140 was approved before I got married and at the time when I was applying for my wife's H4 visa and we answered it NO since none of those applications had her linked any where.

My wife is planning to attend for a H4 Visa Re stamping. I have couple of questions regarding the visa application process. Appreciate if you can help me with my questions

1) In DS156 should my answer to the Question� �Has Anyone Ever Files an Immigrant Petition on your behalf� be NO. FYI, my 140 is approved and waiting on 485 priority date. I don�t think I gave my wife�s name yet in my labor or 140 approval process

2) There is a section to be filled in VFS website called� Petition Details from 797/. I assume that principal applicant would be me. However I am not sure what to fill in the following questions
Petition Receipt #
Petition Expiration date
Petitioner Name: I assume it is my company name

Is the above info to be filled in from My 797 ( case type I129)or my wife�s 797( case type I539) Receipt #?

I did it in Ottawa. At that time we could get the visa stamped the same day in Ottawa. Now I think we need to wait for one more day (2 days in all). But make sure you read the Consulate website before proceeding. Different consulates have slightly different procedures.

You have to book the dates for the interview online. Once the date is booked, the Consulate will send you a confirmation letter. You can apply for a Canadian Visitor visa showing this letter.

The Consulate has given a list of required documents. Carry all of them. Also try to get all documents listed on the Chennai consulate too (they have listed more documents), that way you are safe.

Since Canada is almost like the United States, you wont feel that you have reached a strange land. You just feel like you are in another US city!

Thanks for that information! How long did it take you to get it stamped? Did you have to book a date with the consulate there? Can you give me a little walk through?

Hi folks, i am in urgent situation and need your advice.

My 6-year H1B expires by end of April 2011 and I am quitting my job by the end of March and changing my status to H4. My I-140 has been approved, I-485 not submitted. Now I only have 1 month left in the 6-year H1B period and am in H4 after March, can I find a new employer to apply for H1B for me, using the 1 month? If yes, can the new employer apply for a 3-year H1B visa?

any comments/advices would be appreciated.

I guess your H4 is not approved yet and continuing your employment on H1B. Your best course of action would be to have your employer file an extension (beyond 6 years) for H1B and get a 3-year approval (with approved I-140). You can change jobs after this but if you don't want to take this path you can still find a new employer before end of march and apply for H1B to get a 3-Year H1B. You will need to restart your PERM and go through the whole process with your new employer ASAP.

To my knowledge they consider the salary you were getting in the last one year to calculate UI benefits. If you are applying one year after the job loss, chances that you get anything is very low.

Anybody who is eligible to work in US and has enough work credit can apply for unemployment insurance benefits. I think, USCIS will know about this but sending RFE to people about this is not feasible.

My friend got EAD.His wife is on F1 visa.If he starts using EAD instead of applying for H1 extension, Can he able to join his wife to his GC process who is currently on F1 when his priority date become current.His priority date is Sept06.140 Approved.july 2, 2007 filer.485 is pending.

I am in same boat.. I am going mumbai india in feb for stamping. Where are you going for stamping. I heard lately that there is no way we can pre check PIMS. I have asked my lawer but haven't got reply yet.. If you lawer has sent duplicate copy of H1b document to Kentucky Visa center then there should not be issue.( 99.99 % should be safe ).. If not then there is risk involved.

Do you know how a lawyer can send the duplicate copy to Kentucky visa center, my h1 got approved 3-4 weeks ago, can we still send the duplicate copy to kentucky visa center ??? Did you do that ??

I have an issue with my I-94 and need your advice on this.

I came back to US from India vacation on 10-Sep-2007. My H1 Papers from Company-B got approved(on 5-Sep-2007) just before I start from India . So I could not show the new Company-B h1 papers at the Port of entry to the CBP officer. I got my new I-94 date based on the old Company-A H1 papers which is valid till 30-Sep-2007.



I red on the Immigration Forums that USCIS follows last action rule to determine the validity of I-94. In that scenario, the I-94 that comes with my new H1 paper gets invalidated. If it is true, am I out of status after 30-Sep-2007?


Could you please advice on my possible options on this issue?

You are safe. Once you have reached I-485 stage, it is all about you and not your employer. You mentioned that you already changed to a new employer. Technically, your old employer should've revoked your old I-140 after your move. Since, you moved to a new employer you are indicating that your new employer also has a new job that matches your initial Labor application. You have nothing to worry about your old employer closing down.

Enjoy your EAD/AP and hope you get your GC soon.

Restarting wouldn't be a bad idea in my case as i'm EB3 ROW and i do have an approved I140 on EB3.

But in my case i have over 4 years of work experience, but do not have a masters degree, so any idea if that is possible ?

My gut feeling is that regardless if i'm not able to qualify for EB2, my PD JUN 2006 will get current in a couple of months - just hopefull :rolleyes:

Don't you get one from your employer each year. I received paper and soft copy of W-2 (the paper copy has atleast 4 copies) each year.

I do not know about I485...
but it is not hard to get copies of W2. IRS has a service that will give you copies of your fed tax papers including W2s in 60 days. You can also ask you employer, they ususlay keep a copy.

That bug does ring a bell actually. Resizing is a bit of a hassle in WPF - especially if you aren't using the default Windows chrome.

I will need to revisit this tutorial in the future and address some of the pain points that you and others have mentioned :)
